UKIPO Implements New Address for Service Requirements

Following a recent Decision at the UK Trade Marks Registry, the UKIPO has issued notice of a change in practice which will be implemented with immediate effect.

For UK trade mark and design inter partes proceedings, including invalidation, revocation, rectification and opposition proceedings, a UK address for service must be appointed, before the Registry will formally serve documents in these proceedings. 

Where a non-UK address for service is held by the Registry in such matters, the applicant or proprietor must provide a valid UK address for service in order to confirm an intention to defend the proceedings.

A failure to comply with these directions could result in the registration being declared invalid, revoked, or the application being treated as withdrawn.
